O laboratório tinha testado a régua contra o plano, separado bússola de mapa, e a tese tinha terminado onde uma tese honesta termina: apontando uma direção sem fingir ser o território.The series was closed at two. The laboratory had tested the ruler against the plane, separated compass from map, and the thesis had ended where an honest thesis ends: pointing in a direction without pretending to be the territory.
Aí veio o dia 4 de outubro.Then came October 4.
Flávio Bolsonaro terminou o primeiro turno com 47,03% dos votos válidos. Lula, com 45,16%. Foi o primeiro turno mais apertado desde 1989, e no dia 25 o país inteiro vai ser obrigado a fazer exatamente o que a Parte 1 desmontou: espremer tudo o que pensa numa linha reta com dois pontos.Flávio Bolsonaro, the former president’s son, finished Brazil’s first round with 47.03% of the valid votes. It was the tightest first round since 1989, and on the 25th the whole country will be forced to do exactly what Part 1 took apart: squeeze everything it thinks into a straight line with two points on it.

Do outro: se a esquerda ganhar, vira Venezuela, fecham as igrejas, liberam o aborto, a escola vira doutrinação, o banheiro vira unissex. Duas listas de apocalipse, recitadas com a mesma certeza, por gente que jura estar em lados opostos.With the runoff, the dialogue came back. You know it by heart. On one side: if the right wins, it’s over for LGBT people, it’s over for trans people, it’s over for Bolsa Família, it’s over for democracy. On the other: if the left wins, we become Venezuela, the churches get shut down, abortion gets legalized, schools turn into indoctrination, bathrooms go unisex. Two lists of apocalypse, recited with the same certainty, by people who swear they stand on opposite sides.

Não porque ele é barulhento. Porque ele é testável, e quase ninguém testa. Toda profecia política tem uma propriedade que os profetas preferem esquecer: ela tem prazo. “Se ele ganhar, vai acontecer tal coisa” é uma frase que vence. E o Brasil tem uma vantagem rara pra quem quer conferir: os dois lados governaram há pouco tempo. A direita teve de 2019 a 2022. A esquerda tem de 2023 até agora. As profecias dos dois já venceram. Dá pra abrir a gaveta e olhar.Not because it’s loud. Because it’s testable, and almost nobody tests it. Every political prophecy has a property its prophets would rather forget: it has a deadline. “If he wins, this will happen” is a sentence that expires. And Brazil has a rare advantage for anyone who wants to check: both sides governed recently. The right had 2019 to 2022. The left has had 2023 to now. Both sides’ prophecies have already come due. You can open the drawer and look.
É isso que este texto faz. Ele pega os medos dos dois lados, um por um, transforma cada um em previsão com prazo e dado, e confere o que aconteceu. A regra é uma só, do primeiro ao último capítulo: nenhuma profecia entra sozinha. Toda vez que aparecer o “se a direita ganhar, já era”, o espelho da esquerda aparece junto, e os dois são medidos com a mesma régua até morrer, ou até sobreviver, na frente de quem lê.That is what this text does. It takes the fears of both sides, one by one, turns each into a forecast with a deadline and data, and checks what happened. There is only one rule, from the first chapter to the last: no prophecy walks in alone. Every time “if the right wins, it’s over” shows up, the left’s mirror shows up with it, and both are measured with the same ruler until they die, or survive, in front of the reader.

What it wants is for you to reach the ballot box knowing the difference between calibrated fear and sold fear.

Quem tem medo do banheiroWho’s afraid of the bathroom
Esta parte começa num lugar bem menos elevado do que aquele onde a anterior terminou: um banheiro. Não por provocação, mas porque nenhum outro objeto da política brasileira recente concentra tão bem o mecanismo que este texto pretende desmontar. Em outubro de 2022, na reta final do segundo turno, circulava nos grupos de família e nas redes uma profecia com a aparência de notícia: se Lula voltasse ao poder, as escolas teriam banheiro unissex. Ela vinha acompanhada das previsões de sempre, a igreja fechada e o aborto liberado, mas tinha sobre elas uma vantagem retórica considerável. O banheiro é concreto. Todo mundo sabe onde fica, todo mundo já entrou em um, e qualquer pai ou mãe consegue visualizar a porta, o corredor da escola e o filho do lado de dentro. Uma ameaça abstrata precisa ser explicada; uma ameaça com endereço se explica sozinha.This part begins somewhere far less elevated than where the previous one ended: a bathroom. Not as provocation, but because no other object in recent Brazilian politics concentrates so well the mechanism this text sets out to take apart. In October 2022, in the final stretch of the runoff, a prophecy dressed as news circulated through family group chats and social media: if Lula returned to power, schools would get unisex bathrooms. It came with the usual forecasts, churches closed and abortion legalized, but it had a considerable rhetorical edge over them. A bathroom is concrete. Everyone knows where it is, everyone has walked into one, and any parent can picture the door, the school hallway and their child on the other side. An abstract threat needs explaining; a threat with an address explains itself.
No dia 19 daquele mês, Lula reuniu pastores num hotel em São Paulo para lançar a Carta Compromisso com os Evangélicos, e no mesmo encontro respondeu à profecia do banheiro. A resposta merece atenção na forma exata em que foi dada: segundo ele, a ideia de que alguém que é pai, avô e bisavô apoiaria banheiro unissex em escola “só pode ter saído da cabeça do satanás”. O candidato acusado de defender o banheiro não contestou a premissa da acusação. Não disse que a informação era falsa e que, além de falsa, não havia nada de demoníaco numa criança usar o banheiro em paz. Disse que a ideia vinha do diabo. Para se livrar da acusação, aceitou o enquadramento de quem acusava, e com isso a defesa acabou validando o produto que o ataque tentava vender.On the 19th of that month, Lula gathered pastors at a hotel in São Paulo to launch his Letter of Commitment to Evangelicals, and at the same event he answered the bathroom prophecy. The answer deserves attention in the exact form it took: according to him, the idea that someone who is a father, grandfather and great-grandfather would support unisex bathrooms in schools “could only have come out of Satan’s head.” The candidate accused of defending the bathroom did not contest the premise of the accusation. He did not say the claim was false and that, besides being false, there was nothing demonic about a child using the bathroom in peace. He said the idea came from the devil. To shake off the accusation, he accepted the accuser’s framing, and in doing so the defense ended up validating the very product the attack was trying to sell.
Há um detalhe nessa troca que costuma passar despercebido, e ele é o centro do capítulo: quem ficou de fora da conversa inteira. A pessoa trans, e mais especificamente a criança trans, aparece nos dois discursos sem falar em nenhum. Na profecia, ela é a ameaça que o outro lado traria para dentro da escola; na resposta, é a coisa satânica da qual o candidato precisa se distanciar. Os dois lados a usam, cada um na direção que lhe convém, e nenhum dos dois a trata como sujeito com interesse próprio no assunto, que é, afinal, usar o banheiro.There is a detail in that exchange that usually goes unnoticed, and it is the center of this chapter: who was left out of the whole conversation. The trans person, and more specifically the trans child, appears in both speeches without speaking in either. In the prophecy, she is the threat the other side would bring into the school; in the answer, she is the satanic thing the candidate needs to distance himself from. Both sides use her, each in the direction that suits it, and neither treats her as a subject with her own stake in the matter, which is, after all, using the bathroom.
A imagem mais precisa para essa posição é a de uma ficha numa mesa de pôquer. A ficha passa de mão em mão a noite inteira, decide apostas, sustenta blefes, muda o rumo do jogo, e em nenhum momento alguém pergunta o que ela acha da partida. Ela não tem voto, tem valor de troca. Em 2022, a pessoa trans funcionou como a ficha mais alta da mesa, e os dois jogadores apostaram com ela, um para assustar, o outro para provar que não estava assustando ninguém.The most precise image for that position is a chip on a poker table. The chip passes from hand to hand all night, decides bets, props up bluffs, changes the course of the game, and at no point does anyone ask what it thinks of the match. It has no vote, only exchange value. In 2022, the trans person worked as the highest chip on the table, and both players bet with her, one to frighten, the other to prove he wasn’t frightening anyone.
Seria cômodo parar aqui e tratar o episódio como defeito de um lado só, mas a moeda tem outra face, e ela é igualmente instrutiva. Enquanto a direita vendia o banheiro unissex, circulava na esquerda a profecia espelhada: se Bolsonaro permanecesse no poder, acabaria a vida possível para pessoas trans, e o primeiro lugar onde isso se faria sentir seria a porta do banheiro. É provável que você já tenha ouvido essa frase em alguma versão. Ela circula com a mesma confiança da outra e com a mesma pressa de se tornar verdade antes de se tornar fato.It would be convenient to stop here and treat the episode as a flaw of one side only, but the coin has another face, and it is just as instructive. While the right was selling the unisex bathroom, the left was circulating the mirror prophecy: if Bolsonaro stayed in power, livable life for trans people would end, and the first place it would be felt was the bathroom door. You have probably heard some version of that sentence. It circulates with the same confidence as the other one and the same hurry to become truth before it becomes fact.
As duas profecias compartilham a mesma estrutura: um governo vai entrar no banheiro. Uma afirma que ele vai abrir a porta para todos; a outra, que vai trancá-la diante de alguém. E ambas têm uma propriedade que os profetas costumam preferir que ninguém note, a de serem testáveis. Não é preciso especular sobre o que cada lado faria, porque os dois governos aconteceram. Bolsonaro governou de 2019 a 2022, e nenhuma lei federal retirou pessoas trans de banheiro algum. Lula governa desde 2023, e nenhuma política federal instalou banheiro unissex em escola alguma, o que não surpreende, já que o próprio presidente havia condenado a ideia em público. A profecia da direita não se cumpriu. A da esquerda também não. As duas morreram do mesmo jeito, por expiração de prazo, sem que o evento anunciado acontecesse.Both prophecies share the same structure: a government is going to walk into the bathroom. One says it will open the door to everyone; the other, that it will lock it in someone’s face. And both have a property their prophets usually prefer nobody notice: they are testable. There is no need to speculate about what each side would do, because both governments happened. Bolsonaro governed from 2019 to 2022, and no federal law removed trans people from any bathroom. Lula has governed since 2023, and no federal policy installed a unisex bathroom in any school, which is no surprise, since the president himself had condemned the idea in public. The right’s prophecy did not come true. Neither did the left’s. Both died the same way, by expiration, without the announced event ever happening.
Isso vale para o plano federal, e é preciso dizer com clareza onde ele termina. Nas câmaras municipais e nas assembleias estaduais a história é outra: há leis de banheiro em tramitação e há leis de banheiro sendo derrubadas, e esse terreno volta no capítulo 32, porque é nele que o risco concreto se concentra. Quanto ao banheiro da vida real, aquele com fila e porta, o que aconteceu com ele ao longo de quatro governos fica para o capítulo 31, que fecha a moldura aberta aqui. Por enquanto basta uma pista: a resposta é bem menos dramática do que qualquer uma das duas profecias.That holds at the federal level, and I need to be clear about where that level ends. In city councils and state legislatures the story is different: there are bathroom bills moving forward and bathroom laws being struck down, and that terrain returns in chapter 32, because that is where the concrete risk is concentrated. As for the real-life bathroom, the one with a line and a door, what happened to it across four governments is left for chapter 31, which closes the frame opened here. For now, one clue is enough: the answer is far less dramatic than either prophecy.
O que interessa neste ponto é o mecanismo, e ele não é uma divergência de opinião sobre banheiros. É a mesma mercadoria exposta em duas vitrines. Uma vende o medo de que a porta se abra, a outra o medo de que ela se feche, e o cliente sai das duas lojas com a mesma sacola: a convicção de que a vitória do outro lado significa o fim do mundo. Na Parte 1, a régua exigia que você declarasse seu time antes de expor sua opinião. Em 2022, ela foi mais longe e exigiu o seu banheiro. E os dois lados disputaram a porta com tanta intensidade que nenhum deles chegou a entrar.What matters at this point is the mechanism, and it is not a difference of opinion about bathrooms. It is the same merchandise displayed in two shop windows. One sells the fear that the door will open, the other the fear that it will close, and the customer walks out of both stores carrying the same bag: the conviction that the other side’s victory means the end of the world. In Part 1, the ruler demanded that you declare your team before stating your opinion. In 2022, it went further and demanded your bathroom. And both sides fought over the door so hard that neither ever went in.

A régua virou urnaThe ruler became a ballot
A Parte 1 inteira foi dedicada a um instrumento: a régua. Uma linha com a esquerda numa ponta e a direita na outra, herdada da disposição das cadeiras na Assembleia francesa de 1789 e transformada, por hábito e não por argumento, no modelo universal de classificação política. O laboratório mostrou o que a régua apaga: o libertário que quer menos Estado na economia e menos Estado nos costumes, o social-democrata que não é marxista, o religioso que defende a separação entre Igreja e Estado, toda posição que resulta de pensar dimensões independentes de forma independente. Mostrou também que existe alternativa, o plano de dois eixos, e que nele cabem dezenas de perfis que a régua comprime em dois. O que a Parte 1 não precisou dizer, porque ainda não estava acontecendo, é que existe um momento em que a régua deixa de ser hábito mental e passa a ser obrigação formal. Esse momento tem data marcada. Chama-se segundo turno.All of Part 1 was devoted to one instrument: the ruler. A line with the left at one end and the right at the other, inherited from the seating of the French Assembly in 1789 and turned, by habit rather than argument, into the universal model of political classification. The laboratory showed what the ruler erases: the libertarian who wants less State in the economy and less State in private life, the social democrat who is not a Marxist, the religious believer who defends the separation of Church and State, every position that comes from thinking about independent dimensions independently. It also showed that there is an alternative, the two-axis plane, and that dozens of profiles the ruler squeezes into two fit inside it. What Part 1 didn’t need to say, because it wasn’t happening yet, is that there is a moment when the ruler stops being a mental habit and becomes a formal obligation. That moment has a date. It’s called a runoff.
Os números do primeiro turno, já citados na abertura, ficam mais reveladores quando se olha para quem ficou de fora da final. Augusto Cury ficou em terceiro, com 2,89%, e Renan Santos teve 2,25%; somados aos demais nomes, cerca de 9,3 milhões de votos foram para candidaturas que não estarão na urna do dia 25. A abstenção chegou a 21,08% do eleitorado. Esses números descrevem um país que, no primeiro turno, ainda se espalhava pelo plano, de forma desigual e concentrada nos dois polos, mas espalhado. No segundo turno, a urna oferece dois botões, e cada uma dessas posições precisa caber em um deles ou em nenhum.The first-round numbers, already quoted in the opening, become more revealing when you look at who was left out of the final. Augusto Cury came third, with 2.89%, and Renan Santos got 2.25%; added to the other names, around 9.3 million votes went to candidacies that will not be on the ballot on the 25th. Abstention reached 21.08% of the electorate. Those numbers describe a country that, in the first round, was still spread across the plane, unevenly and bunched toward the two poles, but spread. In the runoff, the ballot offers two buttons, and each of those positions has to fit into one of them or into none.
A compressão não é perfeita, e os dados mostram onde ela falha. Na pesquisa Quaest divulgada na véspera do primeiro turno, entre os eleitores de Cury, 34% escolhiam Flávio num eventual segundo turno e 23% escolhiam Lula, o que deixa mais de quatro em cada dez fora dos dois nomes. Entre os eleitores de Renan Santos, a divisão era de 60% para Flávio e 11% para Lula; entre os de Ronaldo Caiado, de 43% e 19%. O que esses percentuais registram não é indecisão no sentido comum da palavra. É o resíduo que a régua não consegue absorver: gente cuja posição no plano não corresponde a nenhum dos dois pontos que sobraram na linha. A Parte 1 tinha um nome para isso, invisibilidade política, e no segundo turno ela ganha a forma concreta do voto branco, do voto nulo e da abstenção.The compression is not perfect, and the data show where it fails. In the Quaest poll released the day before the first round, among Cury’s voters, 34% chose Flávio in a possible runoff and 23% chose Lula, which leaves more than four in ten outside both names. Among Renan Santos’s voters, the split was 60% for Flávio and 11% for Lula; among Ronaldo Caiado’s, 43% and 19%. What those percentages record is not indecision in the ordinary sense of the word. It is the residue the ruler cannot absorb: people whose position on the plane matches neither of the two points left on the line. Part 1 had a name for this, political invisibility, and in the runoff it takes the concrete form of the blank vote, the spoiled vote and abstention.
Antes de criticar o instrumento, é preciso ser justa com ele. O segundo turno não é um defeito do sistema eleitoral. Ele existe para garantir que o eleito tenha a maioria absoluta dos votos válidos, o que dá ao mandato uma legitimidade que uma vitória com quarenta e poucos por cento não teria, e é adotado por várias democracias por esse motivo. Reduzir mais de dez candidaturas a duas, numa eleição presidencial, é uma decisão administrativa razoável. O problema não está na existência da escolha binária. Está no que as campanhas fazem com ela.Before criticizing the instrument, I have to be fair to it. The runoff is not a defect of the electoral system. It exists to guarantee that the winner has an absolute majority of the valid votes, which gives the mandate a legitimacy that a win with forty-something percent would not have, and several democracies adopt it for that reason. Reducing more than ten candidacies to two, in a presidential election, is a reasonable administrative decision. The problem is not the existence of a binary choice. It is what the campaigns do with it.

As fórmulas mudam de peça para peça e de eleição para eleição, mas a estrutura é idêntica: o adversário deixa de ser adversário e passa a ser o fim.An election between two names is a choice about who will head the federal Executive for four years, with a Congress, a Supreme Federal Court, twenty-seven state governments and more than five thousand municipalities running at the same time, each with its own powers. The campaigns, on both sides, convert that administrative choice into an ontological one: the question stops being who governs and becomes whether the country goes on existing. At one end, the race is presented as the last barrier between democracy and coup-mongering; at the other, as the last barrier between freedom and communism. The formulas change from ad to ad and from election to election, but the structure is identical: the opponent stops being an opponent and becomes the end.
Um desses enquadramentos se apoia num fato julgado, e isso não é detalhe; o capítulo 23 é inteiro dedicado a ele. Mas até um medo com fundamento pode ser vendido como profecia total, e é a forma de venda que interessa neste ponto. Quando cada lado anuncia que a vitória do outro encerra a República, algo se perde. O eleitor perde a capacidade de distinguir o que um presidente efetivamente controla do que está fora do alcance dele, e essa distinção, como o Bloco II vai mostrar, é a que separa as profecias que se cumpriram das que morreram por expiração de prazo.One of those framings rests on an adjudicated fact, and that is no detail; chapter 23 is devoted entirely to it. But even a well-founded fear can be sold as total prophecy, and it is the way of selling that matters here. When each side announces that the other’s victory ends the Republic, something gets lost. Voters lose the ability to tell what a president actually controls from what lies beyond his reach, and that distinction, as Block II will show, is the one that separates the prophecies that came true from the ones that died by expiration.

The ruler of the 25th has the force of a rule, and cannot be: nobody escapes choosing between two names or choosing neither. What can still be refused is the rest of the package, the idea that a choice between two names is also a choice between two worlds. The runoff asks you to choose a name. Nobody has to accept that, along with it, they are choosing an end of the world.

A moeda: lado A e lado BThe coin: side A and side B
Medo não é defeito de raciocínio. É informação sobre risco, e um eleitor que não teme nada provavelmente não entendeu o que está em jogo numa eleição presidencial. O problema começa quando o medo deixa de funcionar como informação e passa a ser vendido como certeza. A diferença fica clara quando se compara uma previsão do tempo com uma profecia. A previsão diz que há setenta por cento de chance de chuva amanhã à tarde na zona norte: tem probabilidade, tem prazo, tem lugar, e no dia seguinte qualquer pessoa pode olhar pela janela e conferir se acertou. A profecia diz que vai acabar tudo. Não informa quando, não explica como, e por isso nunca pode ser desmentida no dia seguinte, só esquecida no próximo ciclo eleitoral e substituída por outra.Fear is not a reasoning defect. It is information about risk, and a voter who fears nothing has probably not understood what is at stake in a presidential election. The problem starts when fear stops working as information and starts being sold as certainty. The difference becomes clear when you compare a weather forecast with a prophecy. The forecast says there is a seventy percent chance of rain tomorrow afternoon on the north side of town: it has a probability, a deadline, a place, and the next day anyone can look out the window and check whether it got it right. The prophecy says everything is going to end. It doesn’t say when, doesn’t explain how, and that is why it can never be refuted the next day, only forgotten in the next election cycle and replaced by another.
O produto que os dois lados vendem no segundo turno pertence à segunda categoria, e tem uma anatomia reconhecível. Começa por uma condição (se o outro ganhar), segue para uma consequência total (acabou), e omite duas peças que qualquer previsão séria precisaria ter: o mecanismo e o prazo. “Se a direita ganhar, acabou pros LGBT” e “se a esquerda ganhar, vira Venezuela” são frases ditas por pessoas que se consideram adversárias, mas são montadas com as mesmas peças e com as mesmas ausências. O que se oferece ao eleitor não é uma hipótese sobre o futuro, é uma imagem do fim, e imagens não precisam de prazo para funcionar.The product both sides sell in the runoff belongs to the second category, and it has a recognizable anatomy. It starts with a condition (if the other side wins), moves to a total consequence (it’s over), and leaves out two parts any serious forecast would need: the mechanism and the deadline. “If the right wins, it’s over for LGBT people” and “if the left wins, we become Venezuela” are sentences spoken by people who consider each other enemies, but they are built from the same parts and with the same gaps. Neither says by what instrument the president would produce the announced end, whether by decree, by law, by pressure on the Supreme Court or by some other route. Neither says how long it would take. What voters are offered is not a hypothesis about the future, it is an image of the end, and images don’t need deadlines to work.

Na estreia do horário eleitoral, em 29 de agosto, Lula usou cerca de um minuto do seu tempo para criticar Flávio, e Flávio dedicou o seu a falar com o eleitorado feminino, de crime e de inflação. O apocalipse costuma morar em outro lugar, nas redes e nos grupos de mensagem, onde ninguém assina nada e a frase circula sem dono.Why that product sells so well, Part 1 had already described: polarization is not a side effect of the ruler, it is one of its working products, useful to whoever benefits from electorates mobilized by fear rather than by analysis. A campaign doesn’t need to prove that its opponent will close churches or persecute trans people. It only needs voters to picture the scene sharply enough that the hypothesis becomes conviction before it becomes a question. That is why the most effective prophecies rarely appear in official ads, which are signed and can be held to account. When the free electoral broadcasts opened on August 29, Lula used about a minute of his time to criticize Flávio, and Flávio spent his talking to women voters, about crime and about inflation. The apocalypse usually lives somewhere else, on social media and in group chats, where nobody signs anything and the sentence circulates without an owner.
A simetria, no entanto, não fica restrita à retórica. Alguns signatários pediram depois a retirada do nome, inclusive candidatos petistas que atribuíram a assinatura a erro da assessoria, e isso precisa ser registrado com a mesma clareza do resto. Ainda assim, o dado é difícil de contornar: a agenda que cada lado acusa o outro de carregar foi assinada pelos dois, e a assinatura mais numerosa veio justamente do lado que mais denuncia a agenda.The symmetry, however, does not stay confined to rhetoric. In September, a feminist group opposed to trans rights began collecting candidates’ signatures on a pledge letter with items such as bathrooms, sports and schools defined by biological sex alone. By September 26, the letter had 150 signatories from 20 parties. Lula’s Workers’ Party (PT) and Bolsonaro’s Liberal Party (PL) were tied, with eight signatures each, and the party with the most names on the list was the PCO, which sits at the far left end of the ruler, with 59. Some signatories later asked to have their names removed, including PT candidates who blamed the signature on a staff error, and that has to be recorded as clearly as the rest. Even so, the fact is hard to get around: the agenda each side accuses the other of carrying was signed by both, and the largest batch of signatures came from the side that denounces that agenda the loudest.

A fear that makes it through all three questions and is confirmed is calibrated fear, and the text will say when that happened. A fear that doesn’t survive them is sold fear. The ruler that Part 1 rejected as a classification tool comes back here in the only role in which it is useful, measuring, and it measures both sides on the same scale.

The objection is fair, and that is why it doesn’t go in a footnote. The symmetry this chapter deals with is the symmetry of the selling mechanism, not of the acts, and the next chapter is devoted entirely to the point where the two sides stop weighing the same. Fear changes its packaging depending on the shop window, but, most of the time, the supplier is the same.

It still has two faces, it still spins in the air when tossed, but it doesn’t land the same way. The previous chapter showed that both sides sell fear with the same mechanism, and that claim holds. What it does not license is the conclusion that both sides weigh the same in everything. They don’t. And a text that sets out to measure prophecies with the same ruler cannot hide, right here, the point where the ruler registers a difference.

The candidacy of Flávio Bolsonaro, who finished the first round in the lead, was his father’s choice, since the father could not run.

Numa democracia, o resultado da eleição é o árbitro da partida, a única peça que todos os jogadores aceitam antes de começar, e tentar anulá-lo não é agredir o adversário, é agredir o árbitro. Por isso o medo de que “acabe a democracia”, vendido pelo lado esquerdo da régua, tem um tipo de lastro que o medo de que o país “vire Venezuela” não tem: um dos dois foi tentado, investigado e julgado.The distinction that matters here is not one of degree, it is one of kind. Corruption scandals, however serious, happen inside the game: someone uses power to gain an advantage, rigs public tenders, buys support, and the damage, however enormous, is done from within rules that remain in force. A coup attempt is an attack on the rules themselves. In a democracy, the election result is the referee of the match, the one piece every player accepts before the game begins, and trying to annul it is not an assault on the opponent, it is an assault on the referee. That is why the fear that “democracy will end,” sold by the left end of the ruler, has a kind of backing that the fear of the country “becoming Venezuela” lacks: one of the two was attempted, investigated and judged.

Em 2021, o próprio STF anulou as condenações, por incompetência da vara de Curitiba, e reconheceu a parcialidade do juiz Sergio Moro.No narrative walks into this text alone, and this one also has a mirror. For much of the right, Bolsonaro’s conviction is political persecution: a trial conducted by a court that figured at the same time as target and as judge, in an environment in which the Supreme Court had piled up unprecedented prominence. That reading needs to be presented in its strongest version, because it has a precedent the left knows well. In 2018, Lula was jailed after being convicted in the Lava Jato (Car Wash) investigation and spent 580 days behind bars. The left called the process lawfare, persecution by means of the judiciary. In 2021, the Supreme Court itself annulled the convictions, on the grounds that the Curitiba court lacked jurisdiction, and recognized that judge Sergio Moro had been biased.
O espelho, portanto, existe, e ele é revelador: cada lado aplica ao seu líder a narrativa da perseguição e ao líder do outro a narrativa da justiça feita. É a moeda de novo, desta vez dentro do tribunal. Só que as duas narrativas não terminaram do mesmo jeito, e o texto precisa registrar a diferença com o mesmo rigor com que registrou a semelhança. No caso de Lula, a Justiça reconheceu vícios no processo, o que deu à tese do lawfare uma confirmação parcial, embora as anulações tenham sido processuais e não uma declaração de inocência no mérito. No caso de Bolsonaro, até agora, nenhum tribunal reconheceu perseguição, e a condenação está de pé. A discussão sobre o desenho institucional do Supremo, sobre ministros que acumulam papéis e sobre os limites da atuação da Corte, é legítima e merece ser feita, mas ela não apaga o que foi julgado.So the mirror exists, and it is revealing: each side applies the persecution narrative to its own leader and the justice-served narrative to the other side’s leader. It’s the coin again, this time inside the courtroom. Except the two narratives did not end the same way, and the text has to record the difference as rigorously as it recorded the resemblance. In Lula’s case, the courts recognized flaws in the process, which gave the lawfare thesis partial confirmation, even though the annulments were procedural and not a declaration of innocence on the merits. In Bolsonaro’s case, so far, no court has recognized persecution, and the conviction stands. The debate about the Supreme Court’s institutional design, about justices who accumulate roles and about the limits of the Court’s reach, is legitimate and deserves to be had, but it doesn’t erase what was judged.

It qualifies it. The mechanics of selling fear remain symmetrical, and chapter 24 will show that even a well-founded fear is often sold as total prophecy, as if every right-wing victory were, by definition, a new coup. And Flávio is not Jair: the weight of a conviction falls on the person who was judged, even if the son’s candidacy was built on the father’s political capital. What the acknowledgment changes is the reading: whoever compares the two faces has to admit that one of them carries a concrete attempt against the rule that lets the coin be tossed at all.

Este capítulo pega as profecias que circulavam no lado esquerdo da régua sobre um governo de direita, aplica a cada uma as três perguntas do capítulo 22 (o que, em quanto tempo, por qual camada do Estado) e confere o que aconteceu entre 2019 e 2022. Ao lado de cada uma aparece a profecia espelhada que o lado direito vendia sobre a esquerda, porque nenhuma narrativa entra sozinha neste texto. “Se a direita ganhar, acaba o Bolsa Família.” O programa de fato deixou de existir com esse nome: em novembro de 2021 foi substituído pelo Auxílio Brasil, criado pela Lei 14.284. Mas o que a profecia anunciava era o fim da transferência de renda, e o que aconteceu foi o contrário. O benefício mínimo subiu para R$ 400 e, em julho de 2022, a Emenda Constitucional 123 elevou o valor para R$ 600 até dezembro, dentro de um pacote que também criou auxílio para caminhoneiros e ampliou o vale-gás. É legítimo apontar que o aumento veio em ano eleitoral e com prazo de validade colado no calendário da urna, e que a proposta de torná-lo permanente foi rejeitada no Congresso. Nada disso, porém, se parece com o fim do programa. O espelho do outro lado dizia que a esquerda quebraria o país com assistencialismo, e ele é testado no capítulo seguinte, junto com a inflação. Como previsão, o fim do Bolsa Família falhou.“If the right wins, Bolsa Família is over.” The cash-transfer program did in fact stop existing under that name: in November 2021 it was replaced by Auxílio Brasil, created by Law 14,284. But what the prophecy announced was the end of cash transfers, and what happened was the opposite. The minimum benefit rose to R$400 and, in July 2022, Constitutional Amendment 123 raised it to R$600 until December, in a package that also created aid for truck drivers and expanded the cooking-gas voucher. It is fair to point out that the increase came in an election year, with an expiry date glued to the ballot calendar, and that the proposal to make it permanent was rejected in Congress. None of that, however, looks like the end of the program. The mirror on the other side said the left would bankrupt the country with handouts, and it gets tested in the next chapter, along with inflation. As a forecast, the end of Bolsa Família failed. A aposentadoria era a segunda vítima anunciada: “se a direita ganhar, acaba a aposentadoria”. A reforma da Previdência foi promulgada em 12 de novembro de 2019 como Emenda Constitucional 103, com idade mínima e regras de contribuição mais duras. Quem dizia que as regras ficariam piores para o trabalhador estava certo, e isso precisa ser registrado sem atenuação. Quem dizia que a aposentadoria ia acabar estava errado. A reforma passou pelo Congresso, com votos que iam muito além do campo bolsonarista, e o governo seguinte, que a havia combatido, governou com ela em vigor. Em janeiro de 2023, o novo ministro da Previdência chamou a reforma de “antirreforma” e falou em revê-la; no dia seguinte, a Casa Civil afirmou que não havia proposta alguma em análise, e em 2025 o mesmo ministro admitiu que não haveria contrarreforma até o fim do mandato, por falta de maioria no Congresso. O lado que denunciou a mudança herdou a mudança e não a desfez, o que diz alguma coisa sobre o tamanho real da divergência, e também sobre a distância entre falar e fazer, que volta no capítulo 30. Resultado parcial.Pensions were the second announced victim: “if the right wins, retirement is over.” The pension reform was enacted on November 12, 2019, as Constitutional Amendment 103, with a minimum retirement age and stricter contribution rules. Those who said the rules would get worse for workers were right, and that has to be recorded without softening. Those who said retirement would end were wrong. The reform went through Congress with votes from well beyond Bolsonaro’s camp, and the next government, which had fought it, governed with it in force. In January 2023, the new social security minister called the reform an “anti-reform” and talked about revising it; the next day, the president’s chief of staff said no proposal was under review, and in 2025 the same minister admitted there would be no counter-reform before the end of the term, for lack of a majority in Congress. The side that denounced the change inherited the change and didn’t undo it, which says something about the real size of the disagreement, and also about the gap between saying and doing, which comes back in chapter 30. Sobre o patrimônio público, a profecia vinha dobrada: “se a direita ganhar, privatiza tudo e acaba o SUS”. A Eletrobras foi privatizada em 2022, e a política de desestatização avançou em outras frentes. O SUS, no entanto, continuou existindo, atravessou a pandemia como o principal instrumento de vacinação do país e não foi objeto de nenhuma proposta de extinção. O espelho, vendido pelo lado direito, era o de que a esquerda reestatizaria o que estivesse privatizado, e ele tem um teste preciso. Lula chamou a venda da Eletrobras de crime de lesa-pátria, e em 2023 o governo foi ao Supremo contra o limite de 10% no poder de voto da União, que detém cerca de 43% das ações. O desfecho, em março de 2025, foi um acordo que manteve o limite, deu à União três das dez cadeiras do conselho e transferiu ao governo os custos futuros de Angra 3; o próprio relator no STF fez questão de registrar que a ação não buscava reestatizar a empresa. A profecia da direita morreu, e a promessa da esquerda de desfazer a privatização morreu junto. Resultado parcial: privatizou-se parte do que se anunciou, e o que se anunciou como fim do sistema público de saúde não aconteceu.On public assets, the prophecy came doubled: “if the right wins, they’ll privatize everything and end the SUS,” Brazil’s public health system. Eletrobras, the state power company, was privatized in 2022, and the privatization policy advanced on other fronts. The SUS, however, kept on existing, carried the country’s vaccination effort through the pandemic and was never the target of any proposal to abolish it. The mirror, sold by the right, was that the left would renationalize whatever had been privatized, and it has a precise test. Lula called the sale of Eletrobras a crime against the nation, and in 2023 the government went to the Supreme Court against the 10% cap on the voting power of the federal government, which holds about 43% of the shares. The outcome, in March 2025, was a settlement that kept the cap, gave the government three of the ten board seats and shifted to it the future costs of the Angra 3 nuclear plant; the rapporteur at the Supreme Court made a point of noting that the case did not seek to renationalize the company. The right’s prophecy died, and the left’s promise to undo the privatization died with it. Partial result: part of what was announced got privatized, and what was announced as the end of public health care did not happen. ParcialPartial
“Se a direita ganhar, vem a Escola sem Partido e a censura ao professor.” Esta é uma das profecias mais instrutivas do placar, porque ela morre pelas mãos de quem deveria cumpri-la e de quem deveria impedi-la ao mesmo tempo. Nenhuma lei federal inspirada no movimento foi aprovada. Em agosto de 2020, o STF derrubou a lei de Alagoas que instituía a chamada “Escola Livre”, com um único voto divergente, e o criador do movimento anunciou que se afastava dele, dizendo que não havia encontrado apoio no governo federal, isto é, no governo que supostamente seria seu veículo. O espelho, vendido pela direita, era o da doutrinação e da “ideologia de gênero” que a esquerda imporia às salas de aula, e ele terminou no mesmo lugar: o Supremo também derrubou leis municipais que proibiam o tema, e nenhum governo federal, de nenhum dos lados, criou política nacional nesse sentido. As duas profecias falharam, e falharam no mesmo tribunal.“If the right wins, here comes Escola sem Partido and censorship of teachers.” Escola sem Partido (School Without Party) was a movement to police what teachers say in class, and this is one of the most instructive prophecies on the scoreboard, because it dies at the hands of those who were supposed to fulfill it and those who were supposed to block it at the same time. No federal law inspired by the movement was passed. In August 2020, the Supreme Court struck down an Alagoas state law that created a so-called “Free School,” with a single dissenting vote, and the movement’s founder announced he was stepping away from it, saying he had found no support in the federal government, that is, in the very government that was supposed to be his vehicle. The mirror, sold by the right, was the indoctrination and “gender ideology” the left would impose on classrooms, and it ended up in the same place: the Supreme Court also struck down municipal laws banning the topic, and no federal government, from either side, created a national policy in that direction. Both prophecies failed, and they failed in the same court. FalhouFailed
Nas armas, a fórmula era cinematográfica: “se a direita ganhar, o país vira faroeste”. Aqui o dado é mais incômodo para os dois lados. O número de colecionadores, atiradores e caçadores com registro ativo saltou de 117 mil em 2018 para 783 mil em 2022, depois de dezenas de decretos e portarias que flexibilizaram o acesso a armas e munição. Ao mesmo tempo, as mortes violentas intencionais, que haviam batido recorde em 2017, caíram em 2018 e em 2019, voltaram a subir em 2020 e recuaram em 2021. O país não virou faroeste, mas o Fórum Brasileiro de Segurança Pública estima que, sem o aumento das armas em circulação a partir de 2019, o país teria registrado 6.379 homicídios a menos até 2021. O espelho é dos mais nítidos de todo o texto: em 2022, o próprio Bolsonaro dizia que a esquerda viria recolher as armas e transformar clube de tiro em biblioteca. A partir de 2023, o novo governo restringiu o acesso por dois decretos. Eles limitaram o número de armas por CAC, devolveram calibres como o 9 milímetros ao uso restrito e suspenderam novos registros de clubes. As concessões de novos registros de CAC caíram para 272 em 2023 e ficaram em 67.859 em 2024, o menor número desde 2017, e o STF validou os decretos em 2025. Nada disso se parece com o que a profecia anunciava: não houve recolhimento geral de armas, e os clubes de tiro não viraram bibliotecas. Para o lado esquerdo, resultado misto; para o espelho do lado direito, falhou.On guns, the formula was cinematic: “if the right wins, the country turns into the Wild West.” Here the data is uncomfortable for both sides. The number of collectors, sport shooters and hunters (known in Brazil as CACs) with active registrations jumped from 117,000 in 2018 to 783,000 in 2022, after dozens of decrees and ordinances that loosened access to guns and ammunition. At the same time, intentional violent deaths, which had hit a record in 2017, fell in 2018 and 2019, rose again in 2020 and dropped back in 2021. The country did not turn into the Wild West, but the Brazilian Forum on Public Security estimates that, without the increase in guns in circulation from 2019 on, the country would have recorded 6,379 fewer homicides through 2021. The mirror is one of the sharpest in the whole text: in 2022, Bolsonaro himself said the left would come to confiscate guns and turn shooting clubs into libraries. From 2023 on, the new government restricted access through two decrees. They capped the number of guns per CAC, returned calibers such as the 9 millimeter to restricted use and suspended new club registrations. New CAC registrations fell to 272 in 2023 and stood at 67,859 in 2024, the lowest since 2017, and the Supreme Court upheld the decrees in 2025. None of that resembles what the prophecy announced: there was no general confiscation of guns, and the shooting clubs did not become libraries. The annual deforestation rate measured by PRODES, the satellite program run by Brazil’s space research institute (INPE), stayed above 10,000 square kilometers every year from 2019 to 2022, something that hadn’t happened since 2008, and reached 13,038 square kilometers in 2021. The figure that completes the picture is what came next: in 2024, the rate fell to 6,288 square kilometers. The destruction responded to the dismantling of enforcement, and receded when enforcement resumed, which makes this the clearest case of a calibrated fear, with an identifiable mechanism and a verifiable deadline. The right’s mirror said that resuming enforcement would wreck agribusiness, and it has to be measured with the same ruler. In 2023, the year deforestation started to fall, agricultural GDP grew 15.1%, the highest result in the national statistics bureau’s series, and the 2024/25 grain harvest was heading for a new record, close to 340 million tonnes. Democracy did not end, because the institutions held and the election result was respected, but the prophecy was not delusion: it pointed at a concrete action that was in fact attempted. What the prophecy does not license is the total version in which it is usually sold, the one in which any right-wing victory would be, by definition, a new coup, as if every candidate from that camp automatically carried someone else’s conviction. The right’s mirror, that the left would install a dictatorship or sweeping censorship, is the most disputed of all, and so it moves to the next chapter with the care it demands. “Se a esquerda ganhar, o país vira Venezuela.” A previsão nunca veio com mecanismo, mas veio com imagem: prateleira vazia, hiperinflação, propriedade privada confiscada. O dado mais direto para testá-la é a inflação, que em 2023 fechou em 4,62%, em 2024 em 4,83%, acima do teto da meta, e em 2025 em 4,26%, a menor desde 2018. Não houve expropriação de empresas, controle de preços ou fuga em massa de capitais que se pareça com o cenário anunciado. O debate sobre as contas públicas do período é real e merece ser feito com seriedade, mas ele pertence a outro texto; o que este capítulo mede é a profecia, e a profecia não aconteceu. The most direct data point to test it is inflation, which closed 2023 at 4.62%, 2024 at 4.83%, above the target ceiling, and 2025 at 4.26%, the lowest since 2018. There was no expropriation of companies, no price controls and no mass capital flight resembling the announced scenario. The debate about public finances in this period is real and deserves to be had seriously, but it belongs to another text; what this chapter measures is the prophecy, and the prophecy did not happen. The mirror, sold by the left, said the right would turn the State into a church. What the data show is more prosaic: between 2001 and 2019 the taxation of churches barely changed, and from 2019 on the Bolsonaro government approved tax benefits for places of worship almost every year. Neither side shut a church or founded a theocracy. Both bought the same congressional caucus with the same currency, tax breaks. As a forecast, the closing of churches failed, and failed in reverse. In 2024 a 20% charge on international purchases of up to 50 dollars came into force, the so-called “blouse tax,” which weighed on lower-income consumers and was only repealed in 2026, with the president saying he had accepted it under pressure from the then speaker of the lower house. In the opposite direction, in November 2025 an income tax exemption was signed into law for people earning up to R$5,000 a month, valid from 2026. It zeroes out the tax for about 10 million people and reduces it for another 5 million, offset by a minimum rate of 10% on very high incomes, which reaches 0.13% of taxpayers. The mirror is one of the most ironic in the text: in 2018, it was the right’s candidate who promised to exempt from income tax anyone earning up to five minimum wages, and the tax table went through his entire term without adjustment. O espelho, vendido pela esquerda, dizia que a direita acabaria até com o aborto nos casos já previstos em lei. Em 2024, a Câmara chegou a aprovar, em votação simbólica, a urgência de um projeto que equiparava o aborto após 22 semanas a homicídio, mas o texto travou depois de forte reação pública, e as hipóteses legais seguem as mesmas. In the 2022 letter to evangelicals, Lula declared himself personally against abortion and said the issue belonged to Congress, and the government put forward no proposal for change. The only real movement happened at the Supreme Court: in September 2023, Justice Rosa Weber voted to decriminalize abortion up to the twelfth week, and the trial was suspended right afterward, with no date to resume. The mirror, sold by the left, said the right would end even abortion in the cases already allowed by law. In 2024, the lower house went as far as approving, by voice vote, urgent status for a bill that equated abortion after 22 weeks with homicide, but the bill stalled after a strong public backlash, and the legal exceptions remain the same. Those who say the prophecy came true point to the judiciary. But the difference does not license the conclusion that one side lies and the other tells the truth. It shows something else: where something actually changed, it was almost always the Supreme Court that moved it, and where the Executive acted, it often acted in the direction opposite to the prophecy, as with the churches and the income tax. Mas ela desperdiça o que os dois placares mostram quando são lidos juntos, porque o padrão que aparece não depende de quem fez a profecia. The most tempting reading is a fan’s: one side sees reality better than the other. It is not entirely wrong, and the text has already recorded the difference without softening it. But it wastes what the two scoreboards show when read together, because the pattern that emerges does not depend on who made the prophecy. It depends on where the prophecy was pointing.

And guns offer the cleanest proof of all, because the pen wrote in both directions: one government’s decrees took CAC registrations from 117,000 to 783,000, and the next government’s decrees knocked new registrations down to 272 in its first year. What one decree does, another decree undoes, and that is why fear about what depends on decrees deserves to be taken seriously.

Escola sem Partido and the laws against so-called gender ideology died at the Supreme Court, which ruled that they invaded the federal government’s jurisdiction. Abortion and drug possession moved, or stayed put, at the Supreme Court and in Congress. Churches’ tax immunity is in the Constitution and was widened by a deal with the very caucus that was supposedly going to be persecuted. In all these cases, the prophecy was sold as if the president had a pen that could write anywhere. He doesn’t.

The president writes on the top sheet: decrees, enforcement, budget execution, command of the machine, appointments. Underneath are the others: the law, which goes through Congress; the Constitution and its interpretation, which go through the Supreme Court; the federation, with its states and municipalities and their own powers; and the civil registry, from the registry offices to the National Council of Justice. A prophecy that mistakes the top sheet for the whole map is, in Part 1’s exact sense, a false map: a representation that promises to describe the territory and describes only the layer that suits whoever is selling it.

É preciso, no entanto, não transformar o padrão num novo exagero, agora no sentido contrário. A caneta presidencial também alcança as camadas de baixo, só que por canais específicos e com prazos mais longos. O presidente indica ministros do Supremo, monta ou perde maiorias no Congresso, define prioridades orçamentárias que chegam aos estados. O padrão não diz que o presidente não importa. Diz que ele importa por caminhos identificáveis, e que esses caminhos, e não o apocalipse genérico, são onde o risco real se concentra; o capítulo 32 volta a eles com os números de 2027 em diante. The president’s pen also reaches the lower layers, but through specific channels and on longer timelines. The president appoints Supreme Court justices, builds or loses majorities in Congress, sets budget priorities that reach the states. The pattern does not say the president doesn’t matter. It says he matters through identifiable routes, and that those routes, not the generic apocalypse, are where the real risk is concentrated; chapter 32 returns to them with the numbers from 2027 on. A calibrated fear, on either side, would be far more useful if it pointed at those channels instead of pointing at the end of the world.

If it lives on the top sheet, the fear has an address, and the vote can and should take it into account. That question is what separates fear that works as a compass from fear that is sold as a map.

Por isso, antes de conferir se o “se a direita ganhar, acabou pros LGBT” se cumpriu, este capítulo dá a essa profecia toda a razão que ela tem. Taking apart the caricature of a position proves nothing, it only shows that whoever is taking it apart picked the weakest opponent available. So, before checking whether “if the right wins, it’s over for LGBT people” came true, this chapter gives that prophecy all the ground it has. And it has plenty.
Comece pelo histórico. O presidente eleito em 2018 construiu parte da sua carreira parlamentar em oposição explícita à pauta LGBT, e em fevereiro de 2011, como deputado, esteve entre as vozes mais altas contra o material didático de combate à homofobia que o Ministério da Educação preparava. Segundo a Agência Câmara, disse que o material estimulava a homossexualidade e abria uma porta para a pedofilia, e resumiu a posição numa frase: “Não admito que nas escolas do primeiro grau seja distribuído um kit gay”. Quem tinha medo da sua eleição não estava reagindo a um boato. Estava reagindo a décadas de declarações públicas, feitas por alguém que nunca as escondeu.Start with the track record. The president elected in 2018 built part of his congressional career on explicit opposition to the LGBT agenda, and in February 2011, as a congressman, he was among the loudest voices against the anti-homophobia teaching material the Ministry of Education was preparing. According to the lower house’s news agency, he said the material encouraged homosexuality and opened a door to pedophilia, and he summed up his position in one sentence: “I won’t allow a gay kit to be handed out in primary schools.” Whoever feared his election was not reacting to a rumor. They were reacting to decades of public statements, made by someone who never hid them.
O medo também tinha o que mostrar depois da posse. Em abril de 2019, um decreto extinguiu dezenas de conselhos de participação social, entre eles o Conselho Nacional de Combate à Discriminação LGBT. Em junho, outro decreto recriou o órgão com outro nome, sem nenhuma menção à população LGBT, e reduziu de quinze para três as vagas da sociedade civil. Em 2020 foi revogada a convocação da 4ª Conferência Nacional LGBT, e em dezembro de 2021 o departamento federal dedicado à pauta foi fundido com outros e deixou de existir como estrutura própria. Na cultura, em agosto de 2019, o presidente anunciou numa transmissão semanal que a Ancine não aprovaria mais projetos com certos temas, entre eles o LGBT, e o Plano Nacional de Turismo excluiu o incentivo ao turismo LGBT que constava da versão inicial. Quando o último orçamento elaborado por esse governo chegou ao Congresso, a verba específica para prevenção e enfrentamento da violência LGBTfóbica era de R$ 325 mil, para o país inteiro.The fear also had something to show after the inauguration. In April 2019, a decree abolished dozens of civil society councils, among them the National Council to Combat LGBT Discrimination. In June, another decree recreated the body under a different name, with no mention of the LGBT population at all, and cut civil society’s seats from fifteen to three. In 2020 the call for the 4th National LGBT Conference was revoked, and in December 2021 the federal department devoted to the agenda was merged with others and ceased to exist as a structure of its own. In culture, in August 2019, the president announced on his weekly livestream that Ancine would no longer approve projects on certain themes, LGBT among them, and the National Tourism Plan dropped the LGBT tourism incentive that had been in its first draft. When the last budget drawn up by that government reached Congress, the line item for preventing and fighting anti-LGBT violence was R$325,000, for the entire country.
Há ainda o argumento mais grave, e o mais difícil de medir: o do clima. A tese diz que não é preciso aprovar lei nenhuma para que a violência aumente, porque o discurso que vem do topo autoriza o que acontece na base. Um presidente que trata a pauta como ameaça às crianças e à família não precisa assinar decreto contra ninguém; basta que a frase circule. E o número que sustenta essa tese existe. Segundo a ANTRA, 2020, o segundo ano daquele governo, registrou 175 assassinatos de pessoas trans, o número mais alto desde 2017, e o dossiê daquele ano associou a violência ao discurso contra a chamada ideologia de gênero, que tratava como ataque direto à existência dessas pessoas.Then there is the gravest argument, and the hardest to measure: the climate. The thesis says no law needs to pass for violence to rise, because rhetoric from the top licenses what happens at the bottom. A president who treats the agenda as a threat to children and the family doesn’t need to sign a decree against anyone; it is enough for the sentence to circulate. And the number backing that thesis exists. According to ANTRA, Brazil’s national association of travestis and trans people, 2020, that government’s second year, recorded 175 murders of trans people, the highest since 2017, and that year’s report linked the violence to rhetoric against so-called gender ideology, which it treated as a direct attack on those people’s existence.

Essa pergunta não é retórica, e o capítulo 32 a leva a sério com os números das vagas que se abrem a partir de 2027.Together, these pieces make a serious argument: a record of hostility, a documented institutional dismantling, a budget cut to almost nothing and a year of record violence. That set is what the most elaborate form of the prophecy rests on, the one that looks forward: if all of this happened in four years, with the Supreme Court acting as a counterweight, what would happen under a government able to change the Supreme Court itself? That question is not rhetorical, and chapter 32 takes it seriously with the numbers on the seats opening up from 2027 on.

The right end of the ruler built its LGBT apocalypse about the left the same way, with real pieces stretched until they became the end of the world. The centerpiece was that 2011 material, nicknamed the “gay kit” and used for more than a decade as proof that the left intended to indoctrinate children. The detail usually missing from that story is that the material never reached schools, because it was suspended by the left’s own president, Dilma Rousseff, in May 2011, after pressure from the religious caucuses. The right’s most effective object of fear was buried by the very government that, according to the prophecy, was going to impose it, and even so, in November of that year, with the material already suspended, the same congressman was still warning from the floor that the kit had not been laid to rest.
Os dois apocalipses, portanto, usam peças verdadeiras. A diferença está na natureza das peças, e ela precisa ser registrada com o mesmo rigor do resto. As do lado B são atos de governo: decretos, extinções, cortes, declarações de quem ocupava a Presidência. A do lado A é um projeto que a própria esquerda abandonou antes de existir. Isso torna o medo do lado B mais fundamentado do que o espelho, e o texto não pretende esconder essa assimetria. O que ele vai examinar no capítulo seguinte é outra coisa: se o fim anunciado aconteceu. The difference lies in the nature of the pieces, and it has to be recorded with the same rigor as everything else. Side B’s are acts of government: decrees, abolitions, cuts, statements by the person holding the presidency. Side A’s is a project the left itself abandoned before it ever existed. That makes side B’s fear better founded than its mirror, and the text has no intention of hiding that asymmetry. What it will examine in the next chapter is something else: whether the announced end happened. Real pieces don’t guarantee that the puzzle built from them is real.

O teste: 2019 a 2022 em númerosThe test: 2019 to 2022 in numbers
O capítulo anterior montou o apocalipse com peças verdadeiras. Este confere se o fim anunciado aconteceu, e o período escolhido para o teste é o mais desfavorável possível para quem duvida da profecia: os quatro anos em que o governo mais hostil à pauta LGBT da história recente ocupou o Planalto. Se o território tivesse de ceder em algum momento, teria sido nesse.The previous chapter assembled the apocalypse from real pieces. This one checks whether the announced end happened, and the period chosen for the test is the least favorable possible for anyone who doubts the prophecy: the four years in which the most hostile government to the LGBT agenda in recent history occupied the presidential palace. If the territory was going to give way at any point, it would have been then.
Não cedeu. Em alguns pontos, avançou. Em junho de 2019, no primeiro semestre daquele governo, o Supremo enquadrou a homofobia e a transfobia na Lei do Racismo, por oito votos a três, depois de reconhecer por dez a um que o Congresso estava em mora havia décadas. Em maio de 2020, derrubou por sete a quatro a regra que impedia homens gays e bissexuais de doar sangue, e a Anvisa revogou a restrição dois meses depois. No mesmo ano, o tribunal declarou inconstitucionais leis municipais que proibiam a discussão de gênero nas escolas. Em 2021, o Conselho Nacional de Justiça, pelo Provimento 122, passou a permitir o registro de recém-nascidos intersexo com o sexo “ignorado”, sem obrigar a família a entrar na Justiça para conseguir a certidão, e em 2022 a Lei 14.382, sancionada pelo próprio presidente, passou a permitir a troca do prenome em cartório, uma vez, sem necessidade de justificativa. O processo transexualizador do SUS, que existe desde 2008, não foi revogado.It didn’t. In some places, it advanced. In June 2019, in that government’s first six months, the Supreme Court classified homophobia and transphobia under the Racism Law, by eight votes to three, after recognizing by ten to one that Congress had been in default for decades. In May 2020, it struck down by seven to four the rule that barred gay and bisexual men from donating blood, and Anvisa, the health regulator, revoked the restriction two months later. The same year, the court declared unconstitutional municipal laws that banned discussing gender in schools. In 2021, the National Council of Justice, through its Provision 122, began allowing intersex newborns to be registered with their sex recorded as “unknown,” without forcing families to go to court to get a birth certificate, and in 2022 Law 14,382, signed by the president himself, began allowing a first name to be changed at the registry office, once, with no justification required. The SUS gender-affirming care program, which has existed since 2008, was not revoked.
O dado que melhor mede o território, porém, não vem de tribunal nenhum. Vem dos cartórios, onde pessoas trans retificam nome e gênero desde que o STF autorizou o procedimento sem cirurgia e sem processo judicial, em 2018. Segundo a associação nacional dos registradores, foram 1.129 retificações em 2018, 1.848 em 2019, 1.283 em 2020, com a queda explicada pela pandemia, 1.863 em 2021 e 3.164 em 2022, um aumento de 70% sobre o ano anterior e o maior número da série até então. O último ano do governo que, segundo a profecia, acabaria com as pessoas trans foi o ano em que mais pessoas trans mudaram o próprio documento no Brasil.The data point that best measures the territory, however, does not come from any court. It comes from the civil registry offices, where trans people have been correcting their name and gender since the Supreme Court authorized the procedure without surgery or a lawsuit, in 2018. According to the national association of registrars, there were 1,129 corrections in 2018, 1,848 in 2019, 1,283 in 2020, with the drop explained by the pandemic, 1,863 in 2021 and 3,164 in 2022, a 70% increase over the previous year and the highest number in the series up to then. The last year of the government that, according to the prophecy, would end trans people was the year more trans people changed their own documents in Brazil than ever before.
A urna confirmou o mesmo movimento. Em 2020, Duda Salabert se tornou a vereadora mais votada da história de Belo Horizonte, e Erika Hilton, a primeira mulher trans eleita para a Câmara Municipal de São Paulo. Em 2022, ainda com Bolsonaro no Planalto, as duas foram eleitas as primeiras deputadas federais trans do país, Erika com mais de 256 mil votos e Duda com mais de 208 mil, num ano em que a ANTRA contou pelo menos 79 candidaturas trans.The ballot box confirmed the same movement. In 2020, Duda Salabert became the most-voted city councilwoman in the history of Belo Horizonte, and Erika Hilton the first trans woman elected to São Paulo’s city council. In 2022, with Bolsonaro still in the presidential palace, the two were elected the country’s first trans federal congresswomen, Erika with more than 256,000 votes and Duda with more than 208,000, in a year in which ANTRA counted at least 79 trans candidacies.

Resta o argumento mais grave do capítulo anterior, o do clima, e ele exige a série completa, não o ano que convém a cada lado. Segundo a ANTRA, foram 181 assassinatos de pessoas trans em 2017, 163 em 2018, 124 em 2019, 175 em 2020, 140 em 2021, 131 em 2022, 145 em 2023, 122 em 2024 e 80 em 2025, uma média de cerca de 140 por ano. Lida inteira, a série não acompanha a cor do Planalto. Os dois anos do governo Temer foram mais letais do que três dos quatro anos do governo Bolsonaro, e 2023, primeiro ano do governo Lula, foi mais letal do que 2019, 2021 e 2022. O pico de 2020 coincide com o ano mais duro da pandemia, que empurrou para a rua quem já vivia na rua, e o perfil das vítimas é o mesmo em todos os governos: no dossiê de 2021, 78% eram profissionais do sexo. Isso não prova que o discurso do topo seja irrelevante, porque clima não se mede com a mesma precisão que um cartório, e o texto não vai fingir que mede. Prova que a previsão de que a violência explodiria sob a direita e cederia sob a esquerda não encontra apoio nos números.That leaves the previous chapter’s gravest argument, the climate, and it demands the full series, not whichever year suits each side. According to ANTRA, there were 181 murders of trans people in 2017, 163 in 2018, 124 in 2019, 175 in 2020, 140 in 2021, 131 in 2022, 145 in 2023, 122 in 2024 and 80 in 2025, an average of about 140 a year. Read whole, the series does not track the color of the presidential palace. The two years of the Temer government were deadlier than three of the four years of the Bolsonaro government, and 2023, the first year of the Lula government, was deadlier than 2019, 2021 and 2022. The 2020 peak coincides with the hardest year of the pandemic, which pushed onto the street those who already lived on the street, and the profile of the victims is the same under every government: in the 2021 report, 78% were sex workers. This does not prove that rhetoric from the top is irrelevant, because climate can’t be measured with the precision of a registry office, and the text won’t pretend it can. It proves that the forecast of violence exploding under the right and receding under the left finds no support in the numbers.
O espelho, aqui, sai do teste ainda mais ferido do que a profecia. O lado direito da régua vendia a pauta LGBT como imposição de governos de esquerda, uma agenda que só avançaria se o Planalto quisesse. Os avanços mais importantes da década, a criminalização da transfobia, o fim da restrição ao sangue e o recorde de retificações, aconteceram justamente sob o governo de direita, e apesar dele. A esquerda não pode reivindicá-los, porque não governava. A direita não pode dizer que os impediu, porque não impediu. E o mesmo vale para a violência: quem usa o pico de 2020 como prova de que a direita mata erra pela mesma régua que erra quem trata os números da ANTRA como exagero militante, porque a média de 140 mortes por ano atravessa os dois governos e não pertence a nenhum deles.The mirror comes out of this test even more wounded than the prophecy. The right end of the ruler sold the LGBT agenda as an imposition of left-wing governments, an agenda that would only advance if the presidential palace wanted it to. The decade’s most important advances, the criminalization of transphobia, the end of the blood restriction and the record number of corrections, happened precisely under the right-wing government, and in spite of it. The left can’t claim them, because it wasn’t governing. The right can’t say it stopped them, because it didn’t. And the same goes for violence: whoever uses the 2020 peak as proof that the right kills is wrong by the same ruler as whoever treats ANTRA’s numbers as activist exaggeration, because the average of 140 deaths a year runs through both governments and belongs to neither.

For four years, the pointer turned as far as it could in the announced direction, and the territory, instead of retreating, recorded the highest number of corrected documents, the first trans federal congresswomen and the criminalization of transphobia. The fear had real pieces. The end of the world it announced did not happen.

Quem segurou o territórioWho held the territory
Se o território não acompanhou o ponteiro, alguém o segurou, e o mapa em camadas do capítulo 26 permite dar nome a cada um desses agentes. O Supremo criminalizou a transfobia, derrubou a restrição ao sangue e anulou as leis municipais contra a discussão de gênero nas escolas. O Conselho Nacional de Justiça regulamentou, em 2018, a retificação de nome e gênero direto no cartório, e os cartórios a executaram em escala crescente durante todo o governo que se opunha a ela. O eleitor, por fim, pôs duas mulheres trans na Câmara dos Deputados. Nenhum desses agentes responde à caneta do presidente, e por isso nenhum deles recuou quando a caneta apontou na direção contrária.If the territory didn’t follow the pointer, someone held it, and the layered map from chapter 26 lets us name each of those agents. The Supreme Court criminalized transphobia, struck down the blood restriction and annulled the municipal laws against discussing gender in schools. The National Council of Justice regulated, in 2018, the correction of name and gender directly at the registry office, and the registry offices carried it out on a growing scale throughout the entire government that opposed it. Voters, finally, put two trans women in the lower house of Congress. None of these agents answers to the president’s pen, and so none of them retreated when the pen pointed the other way.
O que caiu, por outro lado, tem uma característica em comum que costuma passar despercebida. O conselho de combate à discriminação LGBT, a conferência nacional, o departamento federal dedicado à pauta, o apoio da Ancine a filmes com essa temática: tudo isso tinha sido criado por decreto, portaria ou ato administrativo, e foi desfeito pelo mesmo tipo de instrumento. Uma dissertação da Universidade Federal do Rio Grande do Sul que analisou as atas do conselho chega a essa conclusão com precisão: ele caiu porque nunca foi criado como política de Estado, ao contrário de outros conselhos instituídos por lei. A distinção é a mais útil que este bloco pode oferecer. Política de governo é aquilo que a caneta cria e que a caneta seguinte pode apagar. Política de Estado é aquilo que mora nas camadas de baixo, na lei, na Constituição, na interpretação do Supremo, e que nenhuma caneta sozinha alcança.What fell, on the other hand, shares a feature that usually goes unnoticed. The council to combat LGBT discrimination, the national conference, the federal department devoted to the agenda, Ancine’s support for films on the subject: all of it had been created by decree, ordinance or administrative act, and it was undone by the same kind of instrument. A master’s thesis from the Federal University of Rio Grande do Sul that analyzed the council’s minutes reaches a precise conclusion: it fell because it was never created as State policy, unlike other councils established by law. That distinction is the most useful thing this block can offer. Government policy is what the pen creates and the next pen can erase. State policy is what lives on the lower layers, in law, in the Constitution, in the Supreme Court’s interpretation, and what no pen alone can reach.
A regra dos dois lados se aplica aqui com uma força incômoda para a esquerda. O conselho que o governo Bolsonaro extinguiu em 2019 havia sido criado em dezembro de 2010, por decreto, no fim do segundo mandato de Lula. Os programas, as conferências e as coordenações dos governos petistas entre 2003 e 2016 se apoiaram, na maior parte, em decretos e portarias, e o projeto de lei que deveria transformar a proteção em lei morreu no Senado depois de oito anos de tramitação sob esses mesmos governos. Quando a direita chegou ao Planalto, desfez com o mesmo instrumento que a esquerda tinha usado para construir. E em abril de 2023, o novo conselho foi recriado do mesmo jeito, pelo Decreto 11.471, o que significa que o próximo presidente pode apagá-lo de novo. Quem constrói na areia não pode culpar apenas quem soprou o vento. The council the Bolsonaro government abolished in 2019 had been created in December 2010, by decree, at the end of Lula’s second term. The programs, conferences and coordinating offices of the PT governments between 2003 and 2016 rested, for the most part, on decrees and ordinances, and the bill that was supposed to turn that protection into law died in the Senate after eight years of debate under those same governments. When the right reached the presidential palace, it undid them with the same instrument the left had used to build them. And in April 2023, the new council was recreated the same way, by Decree 11,471, which means the next president can erase it again. Whoever builds on sand can’t blame only whoever blew the wind. But the mirror holds too: the right dismantled what was made of sand and couldn’t lay a finger on what was made of stone.

The prophecy said the government would end those rights; what the data show is that the government didn’t have the pen for it, because the rights that mattered were written on layers it couldn’t reach. There is a legitimate discussion about the fact that the layer that held the territory the most is a court nobody elected, and about the limits of the Supreme Court’s reach when Congress fails to act. That discussion exists and deserves to be had, but it doesn’t change the result of the test. The layer held.

In Part 2, I placed myself at the far end of the economic axis, in anarcho-capitalism, the zero State with the market as the only structure of coordination, and I justified that position with the experience of having watched the State create more bureaucracy, cost and fear than protection for those who produce. The sapiocracy, in the last chapter, was designed without a permanent coercive State as its background structure. What chapters 28 and 29 show is that, between 2019 and 2022, what held the territory of people like me were State institutions: a court, a council of justice, the registry offices, the public health system.

Mas o árbitro que existia entre 2019 e 2022 era o do Estado, e seria desonesto, neste texto mais do que em qualquer outro, fingir que não foi ele que segurou.The distinction that lets me cross that contradiction without pretending it doesn’t exist is the one that separates the State that arbitrates from the State that administers. What held the territory between 2019 and 2022 was not the State that plans people’s lives, hands out benefits or decides what each person should be. It was the State that recognizes: the court that said a blood donation rule was discrimination, the registry office that recorded a name without demanding a medical report or a judge, the council of justice that allowed a newborn to be registered without imposing, on the first day of life, a definition of sex the doctors themselves could not yet make. In almost all of these cases, the protection came from the State removing a requirement it had created itself, not from adding a new one. The administering State, the one my coordinate rejects, is what fell: the councils, the secretariats and the funding that depended on a pen. What stayed standing was the arbiter. The ancap coordinate bets that even that arbitration can exist without a monopoly, and that bet is still mine. But the arbiter that existed between 2019 and 2022 was the State’s, and it would be dishonest, in this text more than in any other, to pretend it wasn’t the one that held.

Como qualquer outra profecia deste texto, a queixa merece ser testada antes de ser repetida, e o teste tem duas partes, o que foi dito e o que foi pago.The previous chapter ended with an image: whoever builds on sand can’t blame only whoever blew the wind. This chapter measures what the left built after 2023, and out of what material. It starts from a complaint that has circulated inside the LGBT community itself for years and rarely shows up in writing: that the left talks too much and does too little. Like any other prophecy in this text, the complaint deserves to be tested before it is repeated, and the test has two parts, what was said and what was paid.

In January 2023, the government created a National Secretariat for the Rights of LGBTQIA+ People, the first at that level in the federal structure. In April, it recreated the national council, with 38 members, and in 2025 it held the 4th National Conference, the first since 2016. For anyone who watched those structures being abolished between 2019 and 2021, their return carries symbolic and practical weight, because it gives civil society a seat at the table again. But all of them belong to the top sheet of the map: they were created by the pen and can be erased by it.

Segundo levantamento da Agência Diadorim, o orçamento aprovado para as políticas LGBT do governo federal foi de R$ 27,2 milhões em 2024, dos quais R$ 14,9 milhões foram efetivamente pagos; em 2025, de R$ 23,1 milhões aprovados, foram pagos R$ 17,1 milhões. O dado mais revelador, porém, não é o tamanho da verba, é a origem dela. Em 2024, 72,7% do dinheiro vinha de emendas parlamentares; em 2025, 70,8%; no orçamento de 2026, 76,8%, ou R$ 20,7 milhões. According to a survey by Agência Diadorim, the approved budget for the federal government’s LGBT policies was R$27.2 million in 2024, of which R$14.9 million was actually paid; in 2025, of R$23.1 million approved, R$17.1 million was paid. The most revealing figure, however, is not the size of the money, it’s where it comes from. In 2024, 72.7% of it came from congressional earmarks; in 2025, 70.8%; in the 2026 budget, 76.8%, or R$20.7 million. The government’s own contribution for 2026 came to R$6.7 million, less than the individual earmark allowance each federal congressperson has to distribute in the same year, R$37.2 million. A single congresswoman, Erika Hilton, earmarked R$5.7 million for LGBT policies in 2026 on her own. In money terms, the federal government’s LGBT policy is, three-quarters of it, a policy of the members of Congress who decide to fund it.
Entre o anúncio e a execução, a distância também conta. O governo divulga ter investido R$ 61 milhões na pauta desde 2023, um número plausível quando se somam os valores pagos ano a ano e os restos a pagar de orçamentos anteriores. Já o plano de atenção à saúde da população trans, anunciado em dezembro de 2024, circulou com valores que divergem entre si, de R$ 152 milhões a R$ 443 milhões até 2028. E não saiu do anúncio. O Ministério Público Federal cobrou a publicação da portaria logo depois do lançamento, e em outubro de 2025 as entidades do comitê técnico de saúde LGBTQIA+ do próprio ministério ainda pediam, por ofício, a implementação imediata. Até a última verificação deste texto, a portaria não havia sido publicada. E o programa de governo de 2026 trocou os compromissos específicos de 2022, com metas em saúde, educação e reconhecimento de gênero, por diretrizes transversais, mais vagas e mais difíceis de cobrar.Between announcement and execution, the gap matters too. The government says it has invested R$61 million in the agenda since 2023, a plausible figure once you add up the amounts paid year by year and the carryover from previous budgets. The trans health care plan, on the other hand, announced in December 2024, circulated with figures that don’t match each other, from R$152 million to R$443 million through 2028. And it never got past the announcement. Federal prosecutors demanded publication of the ordinance right after the launch, and in October 2025 the organizations on the ministry’s own LGBTQIA+ health technical committee were still asking, in an official letter, for immediate implementation. As of this text’s last check, the ordinance had not been published. And the 2026 government platform swapped the specific commitments of 2022, with targets in health, education and gender recognition, for cross-cutting guidelines, vaguer and harder to hold anyone to.

O histórico confirma o padrão: foi um governo do PT que suspendeu o material contra a homofobia em 2011 diante da pressão religiosa, foi sob governos do PT que o projeto de criminalização morreu no Senado, e foi o candidato do PT quem, em 2022, condenou o banheiro unissex como coisa do satanás. Na carta antitrans de 2026, o partido apareceu com tantas assinaturas quanto o PL.There are two explanations for that gap, and both are partly true. The first is structural: over the last decade, congressional earmarks have captured a growing share of the budget the Executive could distribute freely, and a government without a majority in Congress has little room to pass laws or expand funding in any area, let alone on an agenda that this Congress rejects. The second is political: the LGBT agenda pays off for the left in speeches and costs it in the evangelical vote, and a government that needs that vote tends to spend words on the agenda instead of money. The record confirms the pattern: it was a PT government that suspended the anti-homophobia material in 2011 under religious pressure, it was under PT governments that the criminalization bill died in the Senate, and it was the PT’s candidate who, in 2022, condemned the unisex bathroom as something out of Satan’s head. On the 2026 anti-trans letter, the party showed up with as many signatures as the PL.
O espelho, mais uma vez, é exato. A direita também fala e não faz, só que com o sinal trocado. The right also says and doesn’t do, only with the sign flipped. It promised its base to end gender ideology and passed no law in that direction; it watched Escola sem Partido die at the Supreme Court without moving its own government to save it; and, in the four years it held the pen, it couldn’t undo a single one of the rights sitting on the lower layers. For the right, the LGBT agenda works as a threat that mobilizes; for the left, as a promise that mobilizes. Neither side needs to deliver what it announces, because what is being sold, in both cases, is the speech, and speeches don’t go through budget execution.

The left says it does and pays little, and the little it pays comes mostly from members of Congress. The right says it will undo and doesn’t, because it can’t reach. For both, the LGBT agenda is worth more on the campaign stage than in the budget, and the one who discovers the difference is not the one who talks, it’s the one who depends on what was promised.

O capítulo 20 abriu este texto com duas profecias sobre um banheiro e prometeu voltar a ele no fim. A pergunta que ficou em aberto era simples: ao longo de todos esses governos, o que aconteceu com o banheiro de verdade, aquele com fila e porta? A resposta passa por um processo que entrou no Supremo antes da primeira profecia e saiu de lá depois da última, sem que ninguém tivesse decidido nada.Chapter 20 opened this text with two prophecies about a bathroom and promised to come back to it at the end. The question left open was simple: across all these governments, what happened to the real bathroom, the one with a line and a door? The answer runs through a case that entered the Supreme Court before the first prophecy and left after the last, without anyone deciding anything.
O caso começou num shopping de Florianópolis. Uma mulher trans, que os autos chamam apenas de Ama, foi retirada do banheiro feminino por um funcionário do estabelecimento. Sem conseguir outro banheiro, não conseguiu se conter no corredor do shopping e voltou para casa com a roupa suja. Na primeira instância, o shopping foi condenado a pagar R$ 15 mil de indenização; o Tribunal de Justiça de Santa Catarina reformou a sentença, por entender que não houve dano moral, apenas um mero dissabor. Ama recorreu ao Supremo, e em novembro de 2014 o tribunal reconheceu que o caso tinha repercussão geral, o que significava que a decisão valeria como parâmetro para todos os casos semelhantes do país. Pela primeira vez, havia uma instituição com caneta suficiente para decidir o banheiro em escala nacional.The case began in a shopping mall in Florianópolis. A trans woman, whom the court records call only Ama, was removed from the women’s bathroom by a mall employee. Unable to find another bathroom, she couldn’t hold it in the mall’s hallway and went home in soiled clothes. At first instance, the mall was ordered to pay R$15,000 in damages; the Santa Catarina state court overturned the ruling, finding there had been no moral damage, only a “mere annoyance.” Ama appealed to the Supreme Court, and in November 2014 the court recognized that the case had general repercussion, which meant the decision would serve as a binding parameter for every similar case in the country. For the first time, there was an institution with a pen strong enough to decide the bathroom on a national scale.
O julgamento começou em novembro de 2015. O relator, Luís Roberto Barroso, e o ministro Edson Fachin votaram para reconhecer que pessoas trans têm direito a ser tratadas socialmente de acordo com sua identidade de gênero, inclusive no uso do banheiro. Em seguida, o ministro Luiz Fux pediu vista, argumentando que o tema envolvia desacordo moral razoável e que vários segmentos da sociedade precisariam ser ouvidos. O processo ficou parado por quase oito anos e só voltou à pauta em junho de 2023, depois de uma mudança no regimento que passou a limitar o tempo dos pedidos de vista.The trial began in November 2015. The rapporteur, Luís Roberto Barroso, and Justice Edson Fachin voted to recognize that trans people have the right to be treated socially according to their gender identity, including in bathroom use. Then Justice Luiz Fux asked for more time to review the case, arguing that the subject involved reasonable moral disagreement and that several segments of society would need to be heard. The case sat still for almost eight years and only returned to the docket in June 2023, after a change in the court’s rules began limiting how long such review requests could last.
A decisão saiu em 6 de junho de 2024. Ela não decidiu o banheiro. Por oito votos a três, o Supremo concluiu que o caso tratava apenas de indenização por dano moral, sem questão constitucional a resolver, cancelou a repercussão geral e encerrou o recurso sem julgar o mérito. O voto que prevaleceu, o do próprio ministro que havia pedido vista, observou que o tribunal estadual não tinha encontrado provas de abordagem motivada por transfobia, e que o Supremo não podia analisar o que a decisão recorrida não havia examinado. Na mesma sessão, a ministra Cármen Lúcia lembrou que é relatora de uma das cinco ações movidas pela ANTRA contra leis municipais que proíbem mulheres trans de usar o banheiro feminino, sinal de que o tema voltará ao tribunal. Até lá, não há tese nacional nenhuma.The decision came on June 6, 2024. It did not decide the bathroom. By eight votes to three, the Supreme Court concluded that the case was only about compensation for moral damages, with no constitutional question to resolve, cancelled the general repercussion and closed the appeal without ruling on the merits. The prevailing vote, written by the very justice who had asked for more time, noted that the state court had found no evidence of an approach motivated by transphobia, and that the Supreme Court could not review what the appealed decision had not examined. At the same session, Justice Cármen Lúcia mentioned that she is the rapporteur of one of the five cases ANTRA filed against municipal laws that bar trans women from using the women’s bathroom, a sign that the issue will return to the court. Until then, there is no national ruling at all.
Considere o calendário. O caso chegou ao Supremo no governo Dilma, ficou parado durante os governos Temer e Bolsonaro, e foi encerrado no governo Lula. Atravessou quatro presidências, duas campanhas inteiras de profecias sobre banheiro e uma frase sobre a cabeça do satanás, e nenhum dos quatro presidentes teve qualquer papel no desfecho, porque nenhum deles tinha caneta para isso. A única instituição que tinha passou nove anos sem usá-la, esperando que a sociedade fosse ouvida; e a instituição que representa a sociedade, o Congresso, também não legislou sobre o tema em momento algum. Quando a decisão finalmente veio, foi a decisão de não decidir.Consider the calendar. The case reached the Supreme Court under the Dilma government, sat still during the Temer and Bolsonaro governments, and was closed under the Lula government. It crossed four presidencies, two whole campaigns of bathroom prophecies and one sentence about Satan’s head, and none of the four presidents played any role in the outcome, because none of them had the pen for it. The only institution that did spent nine years without using it, waiting for society to be heard; and the institution that represents society, Congress, never legislated on the subject either. When the decision finally came, it was the decision not to decide.

The left end of the ruler said, in 2022, that a right-wing government would lock the bathroom door on trans people, and the right end said a left-wing government would open it to everyone. The door was neither locked nor opened by any government, from either side. Opposition congresspeople celebrated the 2024 outcome by saying the issue should be decided by Congress, not by the Supreme Court, which is a defensible position, as long as it is recorded that Congress, holding the pen, didn’t decide either.

The bathroom was neither opened nor closed on a national scale. It stayed undefined, and that lack of definition has a practical consequence: when no authority decides, the decision falls back to whoever is at the door, the mall security guard, the school principal, each city’s council. That is exactly what happened to Ama in Florianópolis, before any prophecy, and it is what keeps happening after all of them. Both sides spent two elections fighting over a door no president controls. Who decides who goes in, to this day, is whoever is standing in front of it.

Doing otherwise would trade an exaggerated fear for an equally exaggerated calm, and calm sold as analysis is just another product in the same shop window. Chapter 26 already pointed the way: the president’s pen reaches the lower layers of the map through specific channels. This chapter follows those channels as far as they go, and the first stop is the place that held the territory the most between 2019 and 2022.

Both sides fear the same channel, and both, when they held the pen, used it to put allies on the court. Two caveats keep this arithmetic from becoming a new prophecy. The first: an appointment is not a vote. The justice who held up the bathroom case for almost nine years and wrote the decision not to decide was appointed by Dilma. The second is that every nomination goes through the Senate, which has just shown, with Messias, that it can say no; the makeup of the Senate coming out of this same election is part of the risk, for either side.

And it has already shown how fast it can move: in 2024, the lower house approved by voice vote urgent status for the bill equating late abortion with homicide, and the Senate gathered the three-fifths needed to pass a constitutional amendment on drugs in direct reaction to the Supreme Court. A president aligned with a congressional majority can turn into law what today is only rhetoric, and a constitutional amendment, once passed, rises to the deepest layer of the map, where not even the Supreme Court reaches easily. That risk also runs in both directions, and neither side, today, has the votes to do it alone.

City councils and state legislatures keep passing laws about bathrooms, schools and language, and many of them end up at the Supreme Court, which sends the issue back to the first channel. It is on these layers that the concrete lives of trans people are decided most often, far from the presidential palace and the electoral broadcasts.

Lula’s platform, for its part, swapped the specific commitments of 2022 for generic guidelines. In both cases, what voters have to evaluate is not a plan, it is a set of channels: whom each would appoint to the Supreme Court, with which Senate, and with which majority in the lower house. Calibrated fear, on both sides, fits inside that question. The real risk in this election is not in the bathroom. It is in the four seats, and in who will confirm who sits in them.

This part is a small, earthly version of the same idea, applied to a single election: check before believing, and measure both sides with the same ruler.

The pen changes hands, and chapter 24 showed that it really does write on the top sheet, in the forests, in the guns, in enforcement. It only means the pen is not the territory. The territory is made of courts, laws, registry offices, city councils and, above all, people, and it moves too, but through its own layers, at its own pace, and rarely in the direction the prophecies announce. Whoever spent two elections watching only the presidential palace’s pointer lost sight of exactly the place where things stayed standing.
